The Electronic Frontier Foundation (EFF), alongside Public Knowledge and Fight for the Future, has urged the Federal Trade Commission (FTC) to withdraw its proposed AI policy statement. The proposal, which builds on the Trump administration’s “Preventing Woke AI” executive order, is criticized as unconstitutional and overreaching. The groups cite three critical flaws: it violates the First Amendment by making the FTC an arbiter of truth; it exceeds legal authority by attempting to preempt state AI laws, such as Colorado’s; and it enables improper jawboning, pressuring companies to censor speech based on partisan ideology. The EFF calls on the FTC to focus on its core consumer protection mission instead.
